I’d also suggest you take a look at the 2011 WWDC session video "Full Screen and Aqua Changes” (starting around the 00:15:00 mark, but you’ll probably want to watch from the beginning for context) for some interesting ways to take control of the full-screen transition to improve the cosmetics and functionality. It always seemed to me that the stuff they do here (I’ll refrain from calling it hackery) ought to have been a standard part of the full-screen API**, and perhaps some of it is now, but it’s a significant improvement over the standard behavior.
If nothing else, you should be able to use this to get your toolbar to do what you want, and to look damn good doing it.
** Especially the part about the non-full-screen window frame *not* being saved with the restorable state by default.
