Last I checked, ProSoft sold an OS X boot disk containing a minimal OS X and Data Rescue+ on it. So at least some third parties are permitted to do something like that. It’s still all at Apple’s discretion, but it’s worth getting in touch with Apple and trying to get that, if it solves your problem.
