NSSplitView divider tracking-area

in a panel, the tracking area for NSSplitView’s divider is only active if the panel is key, i.e. the cursor is not affected otherwise. as a panel is not generally key unless needed, ought not this area be always active? anyone agree? anyone have a workaround?
