I doubt that this is true.
In both cases you are committing data to disk but choosing to overwrite an
existing file or create a new file.
In either case the image you see on screen exists in RAM or in Photoshop's
temporary disk storage - not a fresh read of the updated data that you have
saved to disk.

Well, you can test the theory using Photoshop 7's new JPG *feature*:
1. Make a new CMYK document with a white background
2. Save
3. Measure the white values in CMYK using the eyedropper
4. Close the document
5. Open the document and measure the white values again
6. Marvel at how white has now become C:1 M:1 Y:1 K:0
7. Make a new document as in (1)
8. "Save As" rather than saving
9. Re-do points 3 thru 6 and tell me if there is any difference?
Then make a big sign for your studio so that all the operators are aware
that CMYK JPGs have just been removed from your list of client services.
