I doubt very seriously that would withstand any legal challenge.
It's just a weapon in a manufacturers arsenal incase someone pisses them off,
creates proof a criminal offense, or would devastate their revenue stream. A
manufacturer has to spend money to protect the bigger picture.
It's irrelevant whether it will stand up or not. If the manufacturer drops a
federal civil lawsuit on you, a reviewer, magazine etc.. which is very easy
since they have the lawyers on retainer, your in a world of hurt.
It's can you afford to fight and for how long, even if you do win.
A lot of manufacturers in graphic arts have spent more money then they could
ever collect on what the average person would consider silly lawsuits - HP,
Lasermaster, Tektronics, Encad, Sawgrass, Pantone -- there has been a lot
over the years. You see press releases all the time that xxx and yyy after
years have final reached an agreement -- because it wasn't worth the cost of
fight any more.
