The ones you make yourself will still be governed by the restictions of the
software package they are created with, assuming you aren't rolling your own
profiling software. Such restrictions have eased considerably over the last
couple of years (thanks in part to the efforts of members of this list), but
including profiles in a commercially sold product is one use that would be very
likely to still be protected. Contacting the profiling software developer and
aquiring specific rights for use would be the proper avenue.
