Tell you what, if a profile I create is effectively "owned" by the software company, then I expect them to take full responsibility for it's accuracy and reliability. Better yet, if a profile created by a given piece of software "breaks" a workflow or in any way causes downtime or remakes, then maybe they can be held liable for that.

What's next? If I create a consulting proposal in Word that generates income for me, should Microsoft get a piece of that income because they "own" the Word document?

It's crazy I tell ya!

:-)

There is little legal question that derivatives of copyrighted software can be
protected by copyright. This could lead to some absurd situations, carried to
the extreme, but it does exist, and is the basis for restriction of ICC
profile distribution.

"There is little question"? In an age like ours where practically everything
is done via computers, then, we are all working for the software
manufacturers? All we do belongs to them? The images I work on in Photoshop?
The emails I send? The brochures I lay out in InDesign? Is that the essence
of your remark?

That sounds more like an Orwellian nightmare than what we as free citizens
of western-style democracies should agree to live in.
