If you are working with the headset connector I/O or the line I/O (dock connector), the sample rate is not limited to 8 kHz. In my experience, if the OS has selected the built-in mic, the built-in speaker, or the receiver for input/output on the 2G iPhone, then the sample rate is stuck at 8 kHz.
(I typically work with kAudioSessionCategory_PlayAndRecord.)
