VoIP call during a GSM call

Hi;
I have a VoIP application that is started during a GSM call ( pressing the home button and launching the app, or accepting an incoming push )
The interesting thing is that I can initialize the AudioSession without any problem.
I can set the PlayAndRecord Category, and set the AudioSession Active to true.

I can also create the RIO AudioUnit.
the problem is that iOS 3.1.x and 4.0 behaves differently:
-- On 3.1.3 Is like I can get audio form the mic and send audio to the speaker.
-- On 4.0 I f I send audio to the speaker the phone becomes unstable and sometimes it reboots it self.

There is any way in 3.1 to know that the iPhone is in an active GSM call ? Or at leaset any indication I cannot use the AudioSession
If I know the phone is in a GSM call I will prevent any incoming / outgoing VoIP call to take place.
