Which driver are you referring to, AppleRTL8169Ethernet or AppleACPIPlatform?

Both.

AppleACPIPlatform is of course crucial to the maintenance of a free and
open source platform, and Darwin-8 cannot be classified as such without
it at this time.

In such a case, dedicated FOSS users will be forced to retreat to
Darwin-7 or earlier until the situation is remedied either by release
of the code, or by its replacement.

That is up to you. The driver situation is unlikely to change in the forseeable future.

What about XNU? We are mired at Darwin-8.3 at this time. I have
posted a solution to the alleged problems.

We have nothing to announce regarding xnu for Intel at this time.

Hi all,

In general, we prefer to release all our drivers as open source.
However, in some cases -- such as this one -- there are intellectual
property issues that preclude that. We regret the inconvenience.

Also, as a matter of list etiquette, queries directed solely at Apple
should be submitted as bug reports:

This both helps us ensure a prompt response, and avoids cluttering
the mailboxes of other subscribers. If you have questions about the
status of such a bug, feel free to contact ADC directly to escalate
your concerns:
