It will not work on 3.1 - you must have 3.0, or 3.01. There is no jail breaking required, and no modification of the software. It is not a violation of any agreement, this is functionality that was built into the phone prior to 3.1...
Anyhow, on your IPHONE 3.0, or 3.01 open Safari... (this will not work from anything but the iPhone you want to be able to tether with).

You will be presented with an unsigned ATT MobileConfig file.... install it.
Reboot the phone.
When you boot back up, go to settings > general > network > turn on internet tethering.
You must have itunes 8.2.1 or newer... you can tether with a cord or bluetooth.... Mac or Windows. Apple wrote the tethering on the iphone so it works flawlessly.
this will only work on ATT iPhones, not tmobile.. and upgrading to 3.1 will remove the functionality.
You can undo everything you did above by removing the profile in settings if you so choose.
