AT&T already added through Tweet that upgrading to a new phone will not require changing from your unlimited plan.
Tethering or being a brand new account are the triggers that requires the new choices.
No clue on going out of contract.

will give you graphs of how they're counting your data for each billing
period. I believe AT&T added it recently and it's quite useful. I'm
actually going to be using my iPhone's data as much as possible for the
next billing period to establish a "high water mark" to determine if I
should stay on my grandfathered unlimited plan or go down to the 2GB. I'm
also thinking that with my FAN discount, going down to the 2GB plan may
not be worth it.
I'm more interested in knowing what happens to my unlimited grandfathering
if I upgrade to a new iPhone or go out of contract.
Anyone know?
