Ars doesn't have any inside information; that's just their (reasonable) interpretation of publicly-available information.
The truth is that the public splash pages for both Lion and Lion Server do technically make it sound like Snow Leopard or Snow Leopard Server is a prerequisite (from a license perspective) for Lion and Lion Server, respectively.
This appears similar to the situation with Snow Leopard where, while it was $29, the license was technically for an upgrade from Leopard, leaving Mac OS X 10.4 users seemingly with no direct upgrade path or SKU for Snow Leopard.
