Detecting if fsevents is disabled?

Is there a way to detect whether fsevents is disabled on a certain volume? Does FSEventStreamCreate() fail on such volumes? I'd test it myself except that this leads to me second problem which is that I can't seem to disable fsevents. I created the empty no_log file in the .fseventsd directory and I still get events. This is even after remounting the drive and killing the fseventsd process as well as using a different drive.

I guess I could check for the existence of the no_log file but seeing as I currently have the file in place and it is still enabled means to me that this isn't a reliable method for either disabling or detection.
