This seems to be a bug in the commandline pm tool:
The Resources are not referenced inside the Flat Package's Distribution,
whereas when I set the target lower than 10.5 the installer will
behave as expected, for the price of not having a flat package but a
10.4 style distribution.
But honestly I'm fine with this, since the package is distributed on a
dmg.

Can you post the contents of the Distribution file?
It should contain references to your License, ReadMe or Background
files.
Something like:
<background file="Background.jpg" alignment="Something"
scaling="Something else"/>
<license file="License.txt"/>
<readme file="ReadMe.txt"/>
If it does not, then your resources won't be used.
Hope it can help.
N.B.: I never used the packagemaker tool so I can't tell if you're
using a PackageMaker project to build the FLAT metapackage or it's
built only from the parameters.
