Why can't the software that needs the folders create them instead of
relying on some other piece of software like an installer?

This way the folders do not ever exist until (and unless) they are needed.
Furthermore, a whole class of synchronization bugs become impossible
because the two programs no longer have to be synchronized. This is part of
why "drag install" is so much cleaner than installer programs; it just
works.
