OverridePrimary is not working when ethernet device is manually configured ?

Hi, I developed VPN application which temporarily changes DNS settings via own service and OverridePrimary flag. Service IPv4 configuration is copied from primary service. DNS configuration is created by myself. It's work fine in the case that system ethernet device is configured via DHCP or DHCP with manual addresses. When I use manual configuration of ethernet device, my service is not set as primary even if OverridePrimary flag is set to 1. I tested it on Tiger. Any ideas how it can be solved ?
