AFAIK there's nothing specifically broken about TCPLogNKE. Recently we've moved a bunch of samples to the legacy/retired section simply because they've not been updated in a while, and thus don't compile properly 'out of the box'. This isn't /necessarily/ an indication that the techniques shown in the sample are broken.
Unfortunately the wording used is a little extreme and there's no distinction between stuff that was retired because it's actively toxic and stuff that was retired simply because it doesn't compile. We're working to improve this <rdar://problem/12158573>.
