You are correct that these are the terms and conditions. When it comes to using the iBooks Author and the iBooks Store, it is similar in some ways to the terms and conditions of developing apps for iOS. You can use free Apple tools to create web apps for iOS, and distribute however you wish. For native apps, which can leverage technologies for a greater user experience, you can use Apple's free tools, as long as the app is sold/distributed through the App Store.
Content creators do have a choice. Using Pages, Calibre, Adobe Creative Suite or other tools, ePubs can still be created and distributed however the author wishes. For a more engaged and immersive experience, though, Apple is providing a free tool to create content and then will host it in the iBooks Store. Beyond that, the cost of a textbook cannot exceed $14.99, which is a great thing for students.
