Thanks for the advice, I recreated the HTML/WOD and the message went away.  I suppose it's like you say, only dynamic elements can go without them.

Beyond be annoying the application hangs for a second.  There is no WOD/HTML file so that's obviously the source of the problem, does anyone know how to make the warning go away?  I've tried cleaning the framework & application.
