Cross development with SDK 10.3.9 not compatible with 10.3.8

I cross compile my software for SDK 10.3.9. I seems to me that produced binaries are not compatible with systems earlier that 10.3.9. There are people that use systems 10.3.0 - 10.3.8 who are not happy that they are not able to run my software.

I have tried installing Mac OS X 10.3.0 SDK from XCode 1.5 but installer says that this can be installed on Mac OS X 10.3 only (I have XCode 2.1 + Tiger). Finally, I have managed to install it using third party software.

Is it Ok to use this SDK? Can I use gcc 4.0 or do I have to use 3.3?
