I have no intention of argueing with you, and I am the first to point
out that things are under NDA ... And if you read my post I am adament
about not discussing things like Xcode 3 here.
But -- I know the Apple legal department goes balistic right here --
is it not safe to assume that everybody on this list is at least an
ADC Online Member? Doesn't that make it "OK" to talk about it? Kinda,
like, you know ;) ?

You still have an ADC account involved and getting such an account
(free or otherwise) involves agreeing to the terms of ADC which
includes the pre-release software, etc. agreement (aka NDA).
Anyway, I think the legal section of the release notes make things
clear at this time.
