Apple employees who manage public forums (like me) have been instructed to remind people of the terms of the NDA.

There really isn't anything to discuss here. The NDA is what it is, and you can consult your legal advisor and act as you choose accordingly. But there is really nothing I can do other than to answer the OP's question the same way it's been answered since March:

- use email@hidden for direct questions to the development team
- file bugs at bugreporter.apple.com
- don't discuss the content of nondisclosure materials on public lists.
- don't initiate or perpetuate off-topic threads, and the nature of the iPhone SDK NDA terms is not on topic for xcode-users
