Just to reinforce your findings...I also had the same problems with
Photoshop 6 and 9.04. I got around it by having the Finder open Photoshop.
Tell application "Finder"
open alias "Blah:Blah:Blah" -- your path to photoshop here
end tell
Not really a fix....however it gets the job done.
