There's the potential for a small hole there: suppose a second file

existing one goes away.

Yes. In classic Mac OS, it's unlikely but possible -- AppleScript gives
up control about every 10 ticks, so it could happen. In Mac OS X, it's
much easier -- the script process could be pre-empted at any time.
