Saving Excel with replacing Doesn't work

Does anyone know how to make this work without having the finder delete the
file before saving it?


Save newWkbk In (destinationPathXLS & fileName & ".xls")
with replacing
Close Workbook (fileName & ".xls")

it prompts the user if they mind if it is replaced.
