I read Apple's guidelines a long time ago. I recall thinking at the time
that they were biased a little too heavily in Apple's favor. There's nothing
wrong with Apple's advocating its own position, but I don't think a court
would rule in Apple's favor in every case where Apple's guidelines say you
can't do something.
As to my being covered by the "permission" granted in Apple's guidelines
with respect to web sites, I don't need their permission. My use of the word
"AppleScript" in my web site's title is not proscribed by trademark law, and
Apple's guidelines are therefore irrelevant to me. I do not have to comply
with them in order to be free to use the word AppleScript in this situation.
For example, if I chose to password my site and charge admission, thus
making it "commercial," Apple would have no grounds to complain, nor to
force me to comply with any conditions (as long as my site's title as a
whole was not confusing to Apple's customers). This is the same for the many
books that use "AppleScript" in their titles; they are "commercial" products
and yet their use of the word is within the publisher's rights.
Of course, as I said, being sued is as bad as losing, so I won't tempt them.
Besides, who would pay admission? ;-)
