whose class is... - not working

Please take a look at this:

tell application "Finder" to get class of items of startup disk whose class is not folder

There might be something wrong with the syntax, cause this is not doing what it is meant to. I tried: is not folder class/is not folder type class/is not "folder"/is not class folder/is not (folder as type class)/is not +class cfld; - with no success. In the end I used kind instead of class to get the script working, but I'm still wondering what's wrong with this one.

And I'm also wondering if the kind folder is any different from the class folder.

Using OS 9.1, Script Editor 1.5.5
