OK, I just thought up a new method:

tell app "Finder" to set OS9 to (application file id "MACS" as alias as string) does not end with ":"

Howzzat? :-D

Excellent! Very lateral. There's also this:

tell application "Finder" to set OS9 to ((computer "sysv") < 4096)
