'store script' 2 times => busy!?

When doing:
'store script aScript in file filePath replacing yes'
one time, thereby creating a new file, you can then move it to trash and empty the trash if you want to. That's normal. It shows that the file is not busy.

But if you issue the command two times, i.e so that the file is replaced on the second 'store', the file becomes busy; if you move it to trash and try to empty the trash, you get the message that the operation can not be completed because the item is in use!?

Why is it in use?
And why does it occur only after repacing/overwriting?
Is there a method to release it?

Mac OS X 10.2.8
