Yes. There doesn't seem to be a "path to downloads folder" in AppleScript
and, while you could check "DownloadFolder" in
"~/Library/Preferences/com.apple.internetconfig.plist" in OSX, I haven't got
a clue how to make sense of the data it contains, nor how many browsers
honour this setting.

Yes, and that is probably the best way. Or you could generate it
automatically when ML first runs -- perhaps a Missing Link folder in the
user's prefs folder, but inside that a folder with a randomly generated name
to contain applications or aliases to applications. (I guess ML would have
to keep track of {user:folder} to cope with multiuser machines.) ML can/will
only call to that folder. A folder with a properly randomly generated name
would be harder to guess than most passwords, so would be good security. Add
a droplet like QuickLink to put aliases in the right place for that user.
