I believe that's because the usage is incorrect. What you really should use is the "POSIX file" command , not the "POSIX path" command ...

Indeed 'POSIX file' should have been used*.

* - See 'Dealing with Files' - 'Q: I have an Applescript file or alias object; how do I pass it to a shell command?' at '<http://developer.apple.com/technotes/tn2002/tn2065.html>'. Examples of 'quoted form of' are also explained in the document.
