I've recently uploaded a Finder-imitating sort handler to ScriptBuilders,
which may tide you over until the Finder regains that functionality. Like
the 'sort' in OS 8 and OS 9, it sorts in the same way that items are
displayed in list view windows, but imitates the OS X way of doing things
- on the assumption that that's how 'sort' will work when it's eventually
reimplemented. The code's very long, but it can be hidden away as a
library item. ;-)

Like 'sort' it takes a Finder reference, not an actual list. It can sort
by name, kind, version, label index, modification date, creation date, or
two different interpretations of "size". Tested in 10.2.8.
