What you might want to do is check the various Photoshop preferences files,
to see if that setting is written to any of them. If Photoshop is using too
much custom UI magic, (and in their case, they might be justified), then UI
scripting will have a hard time with it.
Manipulating prefs files might be a better way to go, and if that does work,
would allow you to check ahead of time to see if that checkbox is set
correctly
