Actually, I discovered something odd about how Photoshop handles the
embedding of color profiles. It turns out that it all comes down to
the color settings. Under "Color Management Policies" I was turning
RGB to "Off" and unchecking the three "Ask" checkboxes. I wanted to
insure that as I open the images I'm goiing to be converting I don't
get stopped with dialog boxes. When I have Photoshop configured like
this it doesn't embed a color profile. I found though that if I
configure Photoshop so that RGB is set to "Preserve Embedded
Profiles" and uncheck the three "Ask" checkboxes it will actually
embed the profile. BTW, I'm using "as Photoshop format with options
{embed color profile:true}". What's especially odd is that if I
manually save a file and tell it to embed the color profile while RGB
is set to "Off" it will embed the color profile, it's just if I try
to do so programmatically that it doesn't work. Seems like a bug to
me. I don't know if this behavior exists in CS2 or not.

For RGB images, you generally would want to have a profile
embedded, so that anyone else handling the file will have (and
hopefully use) the opportunity to have the same profile applied
when the file is opened, as opposed to having to either 1) "not
color manage", and implicitly apply their current working space, 2)
explicitly apply their current working space, 3) guess what the
real color space should be. (Some web specialists prefer not to
embed a profile to save their puny 4K of space, but I strongly
disagree with that approach.)
For CMYK images, the jury is more divided, weighing the same
reasons as above against the possibility of some clueless printer
doing an unwanted conversion.
At any rate, if the scripting interface for embedding the working
space profile is not reliable, that is unfortunate.

This is the point I believe your chosen profile is physically and
permanently adjusting the colours in your image, hence (if my
understanding is correct) the image no longer needs the profile
embedded when saving.
