Checking for modal dialog in app

Is there a way to check if an app that im sending an apple script to has a
modal dialog open? I need this because I've noticed that if I send an
applescript to an ap with a modal dialog open, my app locks up until the
modal dialog is closed. I might be missing something also.

Any help appreciated.
