Have you tried rsyncx <http://www.versiontracker.com/dyn/moreinfo/ macosx/16814>?

On that page it states: "You cannot use the standard Mac OS X install of rsync to manage HFS+ volumes."

I don't know how true this is since the product doesn't specifically say that it's been updated for OS X 10.4 and rsync has added the -E option, but it would certainly account for the .DS_Store issue.

it seems very strange that this is something that could have been handled! As you can see my command is using -E and I'm still having the issue (As I mentioned in my re-post, it seemed to only happen with small files)

I can actually get away with the files being temporarily invisible, as no human has a need to see the files in finder anyway, I just thought it would have been nice to sort out.. I'll check out rsyncx though!

There's also some rsync 'exclude' options (-C et. al.) and a --delete- excluded to try out for the .DS_Store files.

-C, --cvs-exclude auto-ignore files in the same way CVS does
--exclude=PATTERN exclude files matching PATTERN
--exclude-from=FILE exclude patterns listed in FILE
