On 13 April 2008, I filed a bug report on a similar problem where the order of windows is reversed when the QuickTime Player application is made invisible. NYF (Not yet fixed).

I wouldn't hold my breath. The bug has been in Safari since the first versions of Leopard, and in Smile we make the best efforts to work around this bug of Cocoa and still it's not perfect. (But at least in Smile "window 1" works, not like in QTPlayer or Safari). Also, I think there is a hard to fix bad interaction with Spaces.
