I wonder if what's happening is that the Finder actually stores comments by writing them to the file's attributes file, similar to using xattr -w with a key of com.apple.metadata:kMDItemFinderComment, and that a Spotlight importer is responsible for getting it from there to Spotlight. A delay in the importing would mean the Finder would be getting stale info back in a Spotlight query.
