With the Finder Hidden:
tell application "Finder" name of windows end tell --> {}
With it NOT Hidden:
tell application "Finder" name of windows end tell --> {"Saved Folders", "Downloads", "folders_nested_copy"}
This Yuk has been true of Safari for some time, but I don't recall it affecting the Finder.
Would someone mind testing on Yosemite, Mavericks, or Mountain Lion?

I get the same result under 10.11.2 but I’m not sure that it’s odd. I’m really surprised that the Finder return 0 window when it is (as well as its windows) hidden.
