FWIW: The actual trash folder is at the root level of each volume and each user's home folder, they are hidden folders.
At the volume level it's named ".Trashes" and at the users level it's named ".Trash". In some Mac OSes, IIRC, pre Leopard, there is only one, which is named "Trash", it is at the volume level and is also hidden.
When you put something into the trash that resides on your startup disk it goes into ~/.Trash, even if it's owned by root. When you put something in the trash not on your current startup disk it goes into <volume_name>/.Trashes/<user_ID>. You can open the home trash folder by using the Go to Folder… in the Go menu in Finder and inputting "~/.Trash". Permissions on /.Trashes is 333 so, in general, it cannot be opened.
Or tell application "Finder" to open folder ".Trash" of home
