Hi,
I9ve got a question for the group regarding the proper legal structure for a
MUG. I know there9s no 3BEST2 structure. I9m really asking how your MUG is
structured and how it works for you. Here9s our situation...
We9re engaged in re-organizing our club (WhatMUG, Bellingham, WA). Until
now, the club hasn9t had any formal, legal structure. It simply had a bank
account in the name of the sole person who was leading the monthly meetings.
When we contacted this bank and several others about opening a new club
account with two new co-signers, they explained that 3Things have changed
since 9/11... There are more security regulations... You must be either an
individual, a Sole Prop., a Partnership, or some form of a Corporation...
and, you must have an EIN (Employer Identification Number).3
In effect, the banks can no longer create accounts for is no legally
recognized entity called an 3association2 or 3club2 any longer (in our state
at least). So, now we9re trying to determine the best legal structure for
the 3new2 club. it looks like we the 3best2 and least hassle approach is
to incorporate as a 3Non-Profit2 corporation. It seems that a good number
of MUG9s are structured this way, but not all.
My question for the group is: HOW IS YOUR MUG STRUCTURED? DOES THAT
STRUCTURE WORK FOR YOUR CLUB? WOULD YOU DO IT DIFFERENTLY IF YOU COULD
START OVER? IF SO, HOW?
