Advertising in background

I Have made some "advertising tests".
- When the app is active, the advertising data contains the "advertising service ID" 
- When the app is inactive, the advertising data DOES NOT contain the "advertising service ID" 

This is the main difference because the PDU length is 30 when background and 34 when active

The pb I see with that solution is that it is not possible for another device (in background) to detect the "advertising device" in background as well..

Because:
To detect a device when in background mode:
1. the "advertising device" needs to send the service ID
2. The scaning device needs to filter on service ID

Any solution to send the serviceID even in background mode ?
