Yes I've noticed. I'm also starting to get used to for example
the new font panel that always stays on top of all other windows.
This was not the case in NEXTSTEP/OPENSTEP, Mac OS X Server 1.x,
and the new feature felt quite inconvenient in the beginning.
In TextEdit the font panel can be made the active window (even
though it doesn't look like it is) and closed with CMD-w. Just
tried it. Don't know if this is the expected behaviour though.
The question then is, what is the definition of a utility window
that cannot be closed with a CMD-w? And what is the definition
of a utility window that can be, eg the info panel in Finder and
the font panel in TextEdit?

Not sure if you noticed, but utility windows should never get focus
(and never do) look at one in IB, the document window widgets remain
active when you click the info window.
