I was under the impression that this behavior is correct under the current
Aqua HI Guidelines. Am I wrong?

But to answer your question with respect to NSTabViewItems, I haven't tried
this yet, but the engineer in charge of NSTabView sent a long email to this
list about a month ago explaining the correct way (under Mac OS X 10.1) to
hook up the next view chain in a window that has a tab view. I have been
wondering if doing it his way will change the behavior about which you
complain.
