Not necessarily.
1) You have to be in a jurisdiction that recognizes copyright in the first
place. If he's in Kyrgyzstan, for instance, he's cool no matter what.
2) The copyright holder has to not allow free trading. Lots do.
3) There has to lack an alternative compensation mechanism. For instance,
the legislation mandating the blank media levy we pay on all CD-Rs etc. (and
perhaps on hard drives soon) here in Canada explicitly allows one to make
personal copies of copyrighted works owned by other people. So if I borrow
your latest Britney CD and rip it for myself, that's legal that's cool here.
I have fourteen chock full MP3 DVDs of ripped music from my friends, and
it's all COMPLETELY LEGAL! Is this a great country, or what? Ho ho!
Downloading said latest Britney CD off Kazaa or whatever isn't specifically
authorized, but there's a lot of legal opinion that holds the implications
of the legislation make that "personal" copying and therefore cool as well.
*shrug* We won't be sure until someone goes to court over it.
Anyway, the point is that there are plenty of ways in which this software
could be completely legal, even given that we assume it's to be used only
for downloading copyrighted music which strikes me as unwarranted in the
first place.

That, I believe, is an inappropriate comment for this forum. However, you
might consider point 3) above. Since I'm paying the legislated media levy,
how can it be immoral for me to do exactly what I'm paying for?
