Something like this happened to another developer several years ago.
I think it was discussed on Kagi's vendor list. If I recall
correctly, his experience was that unless he could show concrete
evidence that he'd lost at least $5,000 because of it, the FBI
wouldn't even talk to him about it. (And his local law enforcement
employees didn't even understand why it was an issue.) The problem,
of course, is that you can't really tell how much you've lost to the
stolen version because you don't know how many people are downloading
and buying the stolen version instead of the real version (unless you
can get his payment processor(s) to give you that information).
Certainly, a letter from your lawyer to the payment processors asking
them to cease and desist selling the copy would help stop the sales,
though.
