I'm not sure about the second problem, but the one mentioned above is definitely a bug that was introduced in Mac OS X 10.3. Adding a separator item into a Dock menu worked perfectly in 10.2.x and earlier, but for some reason the AppKit started drawing a blank item starting in 10.3 _except_ for the separators the Dock adds, such as the one that appears above the "Show in Finder" menu item. So I'd suggest filing a bug report...
