Since many apps (Dock, Spotlight, and many 3rd party apps) can do it, it's obviously possible. Do they all use undocumented API or what?

I may have some other suggestions, but please explain what you want to do. Are you perhaps just looking for a way to intercept hotkeys to trigger a function in your app while it is in the background? For that there is a hotkeys API in the carbon events.
