Why not disable your implementation when running under Tiger? AFAIK,
there's no way to turn VoiceOver off on a per-app basis. If the user
has it enabled, they want to use it. Thus, it would be best for all
apps to use VoiceOver and not have varying implementations.
You may also want to ask this question and get feedback on Apple's
